YARGI ORGANLARI KARARLARINA GÖRE VERGİ KAÇAKÇILIĞI SUÇLARINI ÖNLEMEDE ADLİ VERGİ CEZALARININ ROLÜ

Abstract

Toplumsal yaşamın gerektirdiği tutum ve davranışlara aykırı gerçekleşen eylem ve işlemlerin hukuksal ifadesine suç denilmektedir. Devlete karşı işlenen suçlar kapsamında yer alan vergi suçları vergi kaçırma fiili ile gerçekleşmektedir. Vergi suçlarına ilişkin yargı mercii de ceza mahkemelerinin yetkisindedir. Vergi cezalarının uygulanmasına ilişkin uyulacak usul ve esaslar ceza hukuku genel prensipleri içinde değerlendirilmektedir. Çalışma kapsamında yargı organları kararlarına göre vergi kaçakçılığı suçları ve önlenmesi bakımından adli vergi cezalarının rolü üzerine değerlendirme ve önerilere yer verilmektedir.

The legal expression of actions and transactions that are contrary to the attitudes and behaviors required by the social life are called crimes. The tax offences within the scope of offences against the state are realized by the tax evasion act. The judicial authority for tax offences is also the authority of the criminal courts. The procedures and principles to be followed regarding the application of tax penalties are evaluated within the general principles of criminal law. The study includes evaluations and recommendations on the role of judicial tax penalties in terms of tax evasion offences and prevention according to judicial organs' decisions.
